General Terms and Conditions (GTC) – TCG-Galerie (mpatro.ch)

1. Scope of Application

These GTC apply to all orders placed via the TCG-Galerie webshop (hereinafter "Seller"). The offer is aimed exclusively at customers with a delivery address in Switzerland.

2. Offer and Conclusion of Contract

2.1 The presentation of products in the online shop does not constitute a legally binding offer, but a non-binding online catalog.

2.2 By clicking the button "Order with obligation to pay" (or corresponding wording in the Payrexx checkout), you place a binding order.

2.3 The contract is concluded as soon as the payment is successfully completed in the Payrexx checkout and the Seller confirms the order by email (order confirmation) or ships the goods.

2.4 Price offers ("Make an Offer"): If the Seller offers the "Make an Offer" function, customers can submit an offer. The Seller can accept, reject, or make a counter-offer. A counter-offer from the Seller is valid for 24 hours unless otherwise stated.

3. Prices, VAT and Shipping Costs

3.1 All prices are in Swiss Francs (CHF).

3.2 Without VAT: The Seller is not subject to VAT; no VAT is shown.

3.3 Shipping costs / Shipping method: Shipping costs depend on the shipping method and type of shipment. They are displayed separately and clearly visible before completing the order; the selection and final price are shown in the checkout.

4. Payment (Payrexx)

4.1 Payment is made via the payment service provider Payrexx. The payment methods displayed in the checkout are available.

4.2 Payment is due immediately upon conclusion of the contract. In case of failed or charged-back payment, no shipment will be made; the Seller may cancel the order.

5. Delivery, Shipping Methods and Delivery Times

5.1 Delivery area: Delivery exclusively to addresses within Switzerland.

5.2 Shipping methods:

  • Single Cards / Graded Cards: Shipping via A-Post (Standard) or optional via Registered Mail (surcharge).
  • Sealed Items: Shipping via B-Post (Letter or Parcel, depending on format).

5.3 Delivery times (Post guidelines):

  • A-Post: Delivery usually on the next working day (incl. Saturday).
  • B-Post: Delivery usually latest on the third working day (excl. Saturday).
  • Registered Mail: Delivery against signature, with tracking; usually next working day (Monday–Friday, excl. Saturday), incl. liability up to CHF 500 (according to Post details/GTC).

5.4 Delivery deadlines are non-binding guidelines. Delays (e.g. public holidays, exceptional delivery events) do not justify claims for damages.

6. Typical Delivery Problems and How They Are Handled

These rules correspond to the usual procedure in Swiss mail order business (documentation, investigation, deadlines, evidence):

6.1 Incorrect or incomplete delivery address:
If a delivery cannot be delivered or is returned due to incorrect/incomplete address, the customer bears the costs for redelivery.

6.2 Deposit / Delivery Authorization (Drop-off):
If the recipient has granted the Post a delivery authorization (deposit), the shipment is considered delivered as soon as it has been deposited as agreed; liability claims against the Post may be limited thereby.

6.3 Damaged Shipment / Transport Damage:
Please check the goods immediately upon receipt. Transport damages must be reported to the Seller within 48 hours (photos of packaging + content). The Seller supports the processing (e.g. investigation/damage report). The Post provides for reporting deadlines/processes and partly short deadlines for hidden damages.

6.4 Shipment Delayed:
In case of delays, the Seller supports with investigation information upon request. For certain shipment types, the Post's liability for delay is limited or excluded.

6.5 Shipment Lost / Not Arrived:
For investigations, proof of shipment / tracking number may be required depending on shipping method; investigations can be triggered by sender or recipient depending on the case.
Important Note on Liability for Letters: For letters without receipt confirmation (typically A-Post/B-Post without Registered Mail), the Post provides no liability (CHF 0) according to its GTC; for Registered Mail, there is usually a liability limit (e.g. CHF 500) and better traceability.
The Seller expressly recommends Registered Mail for valuable contents.

7. Return / Revocation

In Switzerland, there is no general statutory right of revocation for online purchases. Orders are binding unless the Seller voluntarily grants a right of return.

Exceptions apply in case of defects according to Section 8.

8. Warranty / Defects (TCG Specifics)

8.1 The statutory provisions of material warranty (CO) apply. In case of defects, the buyer side can notably demand rescission (cancellation), price reduction (abatement) or – depending on the case – replacement.

8.2 Inspection / Notice of Defects: Defects must be reported immediately upon receipt; otherwise the warranty may be restricted.

8.3 Collector Items: For TCG cards, the condition described in the offer as well as available photos/scans are considered agreed quality. For graded cards, the grading label counts as condition statement.

9. Retention of Title

The goods remain the property of the Seller until full payment.

10. Data Protection

10.1 The privacy policy is an integral part of these GTC and available in the webshop under "Data Protection".

10.2 Newsletter: We use the double opt-in procedure for sending our newsletter. You will only receive a newsletter after you have clicked the confirmation link in the sent email. You can revoke your consent at any time (unsubscribe link in the newsletter). We use the service provider SMTP2GO for technical dispatch.

11. Jurisdiction and Applicable Law

Swiss law applies. For consumers, the place of jurisdiction according to Art. 32 CPC applies; this local jurisdiction cannot be waived in advance.

12. Final Provisions

Should individual provisions be invalid, the validity of the remaining provisions remains unaffected.
